With a renewed focus on overtime violations, the US Department of Labor is updating the regulations defining the exemptions from the overtime requirements of the Fair Labor Standards Act. Last week the DOL published its semi-annual regulatory agenda indicating that we can expect a Notice of Proposed Rulemaking (NPRM) in November 2014. The public will have an opportunity to submit their comments on the proposed rules, followed by a period for the DOL to consider the comments and make any changes, although the time frame indicated in the regulatory agenda is not binding on the Department.
