The U.S. Department of Labor, Wage and Hour Division has issued Field Assistance Bulletin No. 2023-1 (FAB) providing guidance on tracking hours worked by employees who telework. The FAB summarizes longstanding principles regarding what constitutes hours worked under the Fair Labor Standards Act (FLSA) and provides useful guidance on an employer’s obligation to maintain an accurate record of hours worked and to provide break time for pumping breast milk, even when its employees are working remotely.
