The N.J. Department of Labor and Workforce Development has announced that it is currently in the process of “a thorough review” of the exemptions from overtime pay relative to analogous provisions under Federal law. Under Federal and state law, certain managerial, professional, administrative and IT workers earning a fixed salary of not less than $455 per week are exempt from overtime pay. The Federal salary level was raised to $913 in 2016 but overturned by a federal court 2017. A state cannot set its salary level lower than the Federal level but can set a higher level. The Department says it intends to complete the review within the next few months and may propose amendments to current regulations.
