The N.J. Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act has been enacted with some provisions effective immediately and some waiting for regulations. While employers are permitted to continue administering health and safety standards, including drug testing, an employer cannot discharge or discriminate against an employee who legally uses cannabis or solely due to the presence of cannabinoid metabolites in the employee’s bodily fluid. The statue co-exists with the Jake Honig Compassionate Use Medical Cannabis Act, which authorizes cannabis for certain medical reasons.
